Philosophy

As our client, you can be assured that Mr. Heldenbrand will oversee all aspects of your legal matter, with thoroughness and precision, clearly explaining the work to be done on your behalf, and advising on the best direction to take in efficiently resolving your legal issues.

Our firm’s litigation philosophy is to prepare early and thoroughly, so that clients can more readily assess their legal position. We do this by obtaining the facts, and the applicable laws, at the very beginning of the representation. Through the years, this philosophy has encouraged and facilitated early resolution, in most instances keeping legal expenditures to a minimum. In other matters, early preparedness leads to summary disposition of cases, or places our opposing parties and their counsel at a significant disadvantage.

In order to best accommodate our clients, we offer weekend and evening appointments. Spanish speakers are welcome. Se habla español.

Collections

Based in Phoenix, J. Mark Heldenbrand, PC represents Arizona creditors in collection proceedings, understanding that unpaid debts can greatly impact the revenue stream of a business and ability to operate. We assist creditors of all types, including federal credit unions, auto lenders, landlords, retailers, wholesalers, doctors, and dentists, and have the resources to collect anywhere in the United States.

Results-oriented, Professional Debt Collection Tactics

At J. Mark Heldenbrand, PC, we emphasize a results-oriented approach to debt collection, working hard to help our clients receive the money they are owed from borrowers, customers, and clients. In our experience, we have found that debtors are often more willing to pay their debts when collections are handled in a polite, courteous manner. Furthermore, professional collection tactics reflect well on our clients, while being effective. Our success is measured by the many long-term relationships we have established with Arizona creditors.

Obtaining a Judgment, Garnishment Order & Other Collection Options

Before taking active measures to collect on a debt, a creditor must receive a judgment in court declaring that the creditor has the legal right to demand payment from the debtor. This generally involves filing a lawsuit against the debtor. Once a judgment has been granted in a creditor's favor, various tools are available to locate and convert debtor assets.

In certain cases, we can obtain a garnishment order, which allows a creditor to take a debtor's property or wages before the debtor has possession of the property or income. Under a wage garnishment order, a creditor can contact the debtor's employer and require the employer to deduct a certain portion of the debtor's wages each pay period and send the money to the creditor. Other methods of collecting on a judgment debt include a levy on the debtor's bank account and/or liens on the debtor's property.

Debtor Assistance

Given our knowledge and understanding of the methods used by creditors to collect on debts, J. Mark Heldenbrand, PC is an invaluable resource for debtors who need assistance dealing with creditors and settling their debts. We have helped many businesses proactively assess their legal options in regard to outstanding bills, and negotiate new and more favorable terms with creditors, thus allowing businesses to continue operations and return to financial stability. Seek Experienced, Effective Representation

At J. Mark Heldenbrand, PC, we understand how to professionally, yet effectively, enforce the rights of creditors in collections cases. If you or your business is unable to collect a valid debt from a customer, client, or borrower, please contact our offices in Phoenix. We represent many creditors on a contingency fee basis, which means your legal fees are deferred until we collect on your behalf. Se habla español.

Landlord-Tenant Law

J. Mark Heldenbrand, PC has assisted clients in commercial and residential landlord-tenant matters for over 25 years. Mr. Heldenbrand is one of Arizona’s leading experts in these areas, and regularly speaks at related continuing education seminars.

Legal services, including both commercial and residential leaseholds/tenancies, include:

  • Rent collection
  • Lease disputes
  • Evictions
  • Defense of lawsuits
  • Defense of fair housing claims
  • Transactional work, including drafting of leases, addendums and purchase agreements
  • Commercial lease disputes

Commercial tenancies

Negotiating and entering into a commercial lease should be done with guidance from an expert. A commercial lease is normally a long-term, binding contract, often involving large sums of money. These types of relationships are normally the product of significant negotiations between a commercial landlord and tenant. As an example, there are no standard forms for commercial leases. If you plan to enter into a commercial lease, or are already in one, either as landlord or tenant, our office can assist with any and all legal issues that may arise.

Residential Landlord Leases

While generally simpler than a commercial lease, residential leases still pose numerous legal concerns to landlords and tenants. For example, landlords must comply with numerous consumer protection laws, such as the Fair Housing Act (which prohibits discrimination in the sale, rental, and financing of apartments or homes based on race, color, national origin, religion, sex, familial status, and handicap), as well as laws capping security deposits and protecting tenant privacy.

J. Mark Heldenbrand, PC has extensive experience handling issues that may arise under residential leases, from collecting back rent to ensuring that evictions are handled properly.

Seek Experienced, Results-Oriented Representation

Rent collections, evictions, or almost any other legal matter, we can provide the advice and representation you need to effectively and efficiently resolve your concern. Likewise, if you are a commercial tenant facing a dispute with your landlord, we can help you assert your rights. Please contact J. Mark Heldenbrand, PC to schedule a consultation. Se habla español.

Real Estate

J. Mark Heldenbrand, PC represents clients in real estate transactions and litigation in the Phoenix metro area and throughout Arizona.

Our experience encompasses both residential and commercial real estate matters, including but not limited to:

  • Buy-sell agreements
  • Trustee sales
  • Misrepresentations involving a purchase or sale
  • Title disputes
  • Boundary disputes
  • Easements
  • Zoning applications, permits, and exemptions
  • Deficiency balances

We also handle real estate matters pertaining to commercial and residential leases, such as alterations to property, improvements, and zoning compliance.

Commercial Real Estate Transactions & Litigation

To say that commercial real estate transactions are complex is an understatement in most cases. Simply keeping up with the constant legal and regulatory changes that impact commercial real estate purchases and leases is enough to warrant the advice of an experienced real estate attorney. Should litigation arise concerning a commercial real estate matter, the stakes are likely high. A business' ability to continue operations is probably in jeopardy, and a large amount of money is usually at issue. We possess the legal skill and resources to protect our clients' interests in commercial real estate, always working to facilitate transactions and resolve disputes as effectively and efficiently as possible.

Residential Real Estate Transactions & Litigation

We understand that buying or selling a home is a huge decision that is often indicative of a major life change. For clients purchasing or selling residential property, we provide legal support from initial planning to closing, reviewing inspections, surveys, financing agreements, and other assessments and documents as necessary to successfully complete the transaction. If you are involved in a dispute with a neighbor or municipality regarding a boundary line, title, easement, or zoning ordinance, we can help protect your rights and resolve the issue at hand.

Assistance for Homeowners' Associations

J. Mark Heldenbrand, PC also assists Arizona HOAs in the collection of unpaid membership dues, appreciating that HOAs often provide many invaluable services for the communities they represent. Our in depth knowledge of collections proceedings ensures that our clients have the best chance possible of receiving the money they are owed.
